These Terms of Service (“Terms”) govern the use of the aduk.art website and related services, products, consultations, and communications offered by ADELYA A., an independent artist / sole trader based in Bulgaria and trading as aduk.art (“aduk.art”, “we”, “us”, or “our”).

 

By using aduk.art, contacting us, booking a consultation, purchasing artwork, enrolling in a course, or commissioning custom work, you agree to these Terms.

 

If you do not agree, please do not use the website or place an order.

 

1. Who we are

If a project-specific agreement, invoice, written brief, quote, booking confirmation, or signed order document contains special terms, those special terms will apply to that order. If there is a conflict, the order-specific terms prevail over these general Terms.

 

2. What aduk.art offers

 

aduk.art may offer, among other things:

  • original or gallery artworks;
  • digital artworks and downloadable art files;
  • fine art, prints, or other physical art items;
  • custom illustration and commissioned art services;
  • creative consultations and paid appointment slots;
  • courses, marathons, workshops, or other educational content;
  • other creative or digital products published on the website from time to time.

Availability, format, timing, pricing, and delivery method may vary by product and by order.

 

3. How orders work

 

At this stage, many orders are discussed and finalized individually through chat, email, messaging apps, or booking flows rather than through an automated webshop checkout.

For custom work and other tailored services, an order is only accepted when we confirm it in writing. That confirmation may be provided through a message, invoice, quote, booking confirmation, brief approval, or separate signed terms.

We reserve the right to decline any request, inquiry, or project before acceptance.

 

4. Pricing and payment

 

Prices may be shown on the website, discussed individually, or confirmed in a custom quote.

Unless stated otherwise:

  • prices are quoted in the currency indicated at checkout, invoice, or offer;
  • payment may be required in full or in part before work, booking, access, or delivery begins;
  • deposits, reservation fees, or milestone payments may be used for custom work;
  • any bank, platform, conversion, customs, tax, or third-party processing fees are the customer’s responsibility unless we state otherwise.

If payment is overdue, we may pause work, delay delivery, cancel access, or release reserved calendar time.

 

5. Product-specific terms

 

5.1 Gallery artworks and ready-made works

 

Some artworks displayed in the gallery may be available for purchase as digital items, originals, prints, or fine art pieces.

 

For digital items, delivery may be made immediately or shortly after payment confirmation by download link, email, cloud folder, or another agreed method.

 

For physical items, shipping method, packaging, insurance, customs, taxes, handling time, and delivery conditions may be discussed and confirmed per order.

 

Colors and appearance may vary slightly depending on screens, materials, print methods, framing, lighting, and other production variables.

 

5.2 Custom illustration and commissioned work

 

Custom commissions are highly individual. Scope, technique, size, timing, usage rights, revision rounds, delivery format, and price are confirmed case by case.

Unless we agree otherwise in writing:

  • work starts only after acceptance of the order and any required payment;
  • timelines are estimates unless we expressly guarantee a deadline;
  • you must provide complete and lawful references, instructions, and approvals in time;
  • revision rounds are limited to those included in the order-specific agreement;
  • substantial changes to the concept, brief, or scope may require repricing, a new timeline, or a new order.
5.3 Courses, marathons, and educational content

 

Courses, marathons, workshops, and similar educational products may be provided as pre-recorded content, live sessions, cohort-based programs, downloadable materials, or a mix of these formats.

Unless explicitly stated otherwise:

  • access is personal, limited, non-transferable, and non-exclusive;
  • you may not copy, redistribute, resell, upload, screen-record for redistribution, or commercially exploit the course materials;
  • access periods, platform availability, and included materials may be limited as described on the relevant offer page.

We may update the structure, timing, platform, or supporting materials of future course runs without affecting rights already granted for the version you purchased, unless a different arrangement is expressly stated.

 

5.4 Consultations and bookings

 

Consultations, reviews, or paid calls are sold as pre-paid time slots and may be booked through aduk.art, book.aduk.art, Cal.com, or another scheduling flow we use.

 

The applicable duration, format, price, and any rescheduling conditions will be shown at the time of booking or in your booking confirmation.

 

Unless otherwise stated in the booking flow:

  • the booking is confirmed only after successful payment;
  • you are responsible for joining on time and using a working contact method;
  • missed sessions, no-shows, and late arrivals may be treated as completed and non-refundable;
  • if we need to reschedule for reasons on our side, we will offer a replacement slot or refund.
5.5 Other offerings

 

Any future products or services not specifically described above are governed by these Terms together with any product page, quote, or order-specific terms published or provided at the time of purchase.

 

6. Delivery and access

 

Digital files, downloads, links, recordings, or course access are considered delivered when they are sent to the email or account provided by you, made available for download, or otherwise made accessible to you.

 

Physical delivery times are estimates only unless expressly agreed otherwise. Risk of loss or delay caused by carriers, customs, incorrect address details, or events outside our reasonable control is not our responsibility once the item has been dispatched, except where mandatory law provides otherwise.

 

You are responsible for providing accurate contact, billing, shipping, and technical access information.

 

7. Revisions, approvals, and client delays

 

For custom work, we may require approvals at sketch, draft, revision, or final stages.

 

Once a stage has been approved by you, later changes to already approved work may be treated as additional paid work.

 

If you stop responding, delay feedback, fail to provide materials, or otherwise pause the project for an unreasonable period, we may:

  • move the project to the back of the queue;
  • revise the delivery timeline;
  • close the order;
  • treat work completed to date as billable.
8. Cancellation, rescheduling, and refunds

 

8.1 General rule

 

Because aduk.art sells a mix of digital items, custom creative services, educational content, and bookings, refund and cancellation rules depend on the type of product and the stage of performance.

 

Nothing in these Terms limits any mandatory rights you may have under applicable consumer law.

 

8.2 Digital artworks and downloadable digital content

 

If you purchase digital content that is delivered immediately or made available for instant access, the sale is final once delivery or access begins, except where mandatory law requires otherwise.

 

Where applicable, by requesting or accepting immediate access to digital content before the end of any statutory withdrawal period, you agree that performance begins immediately and acknowledge that your withdrawal right may be lost once the legal conditions for that loss are met.

 

8.3 Physical artworks, prints, and fine art

 

For ready-made physical goods, any mandatory statutory rights remain unaffected.

 

For made-to-order, personalized, or clearly custom physical artworks, cancellation and refund rights may be limited once production has started, except where mandatory law provides otherwise.

 

If a physical item arrives visibly damaged or the wrong item is delivered, you must contact us within a reasonable time and provide supporting photographs so we can review the issue.

 

8.4 Custom commissions

 

For custom commissions, the exact cancellation and refund structure may be defined in the individual order terms.

Unless otherwise agreed in writing:

  • before work starts, we may cancel the order and refund amounts paid, less any non-recoverable third-party costs or payment processing losses;
  • after work has started, any refund is discretionary and may be reduced to reflect time reserved, work completed, materials used, and project-specific preparation already performed;
  • after the included revision stage has been substantially used, or after final approval / final delivery, no refund is due except where mandatory law requires otherwise.

If you cancel a project after work has started, we may deliver the work completed up to the cancellation point where appropriate.

 

8.5 Courses, marathons, and educational products

 

If a course or educational product includes immediate digital access, download access, or access to protected materials, refunds are generally not available after access has been granted, except where mandatory law requires otherwise.

 

For cohort-based or live programs, additional rules on start dates, missed sessions, and access windows may be stated on the product page or in the order confirmation.

 

8.6 Consultations and bookings

 

Consultation bookings are generally non-refundable once the reserved time is held for you, except where we expressly allow rescheduling or refund in the booking terms, or where mandatory law requires otherwise.

 

If the booking page or confirmation states a rescheduling window, that window will apply.

 

9. Intellectual property and licensing

 

Unless a written agreement expressly transfers ownership, all intellectual property rights in the artwork, drafts, sketches, course materials, downloads, website content, and related materials remain with aduk.art / the artist.

 

A purchase or commission does not automatically transfer copyright.

 

Unless a broader written license or assignment is granted, you receive only a limited license to use the delivered work for the purpose expressly agreed in your order.

 

Unless we agree otherwise in writing, you may not:

  • claim authorship of the work;
  • resell, sublicense, tokenize, mint, commercialize, or exploit the work beyond the agreed license;
  • use the work for AI training, dataset creation, model fine-tuning, or similar machine-learning purposes;
  • modify the work in a misleading or derogatory way;
  • remove signatures, credits, notices, or attribution where included.

If you need commercial rights, exclusivity, broader licensing, or full assignment of rights, those rights must be agreed separately in writing and may require an additional fee.

 

10. Client materials and warranties

 

You represent that any text, image, reference, brief, logo, concept, likeness permission, or other material you provide for a project may lawfully be used for that project.

 

You are responsible for obtaining all permissions, releases, and rights needed for materials supplied by you.

 

We may refuse requests that we believe infringe third-party rights, violate the law, or conflict with our artistic, ethical, or professional standards.

 

11. Portfolio and publication rights

 

Unless the order-specific terms state otherwise, we may display completed or in-progress work, project excerpts, thumbnails, behind-the-scenes material, and your commissioned work in our portfolio, social media, gallery, teaching materials, or promotional channels.

 

If you require confidentiality, delayed publication, or a private commission, this must be agreed in writing before work begins and may involve additional conditions or fees.

 

12. Educational and consultation disclaimer

 

Courses, critiques, consultations, and creative advice are provided for informational and artistic purposes. We do not guarantee any specific artistic, commercial, educational, or personal outcome.

 

13. Website use

 

You agree not to misuse the website, interfere with its operation, attempt unauthorized access, upload malicious code, scrape protected content in violation of law, or use the website in any unlawful or abusive way.

 

We may suspend or restrict access where reasonably necessary to protect the website, our work, or other users.

 

14. Limitation of liability

 

To the fullest extent permitted by law, aduk.art is not liable for indirect, incidental, special, consequential, or purely economic losses, including loss of profit, opportunity, business, or anticipated savings.

 

Where liability cannot be excluded, our total liability for a claim arising out of a specific order will generally be limited to the amount actually paid by you for that order.

 

Nothing in these Terms excludes liability that cannot legally be excluded.

 

15. Privacy

 

Your use of the website and related services is also governed by our Privacy Policy.

 

16. Changes to these Terms

 

We may update these Terms from time to time. The version published on the website at the relevant time will apply unless mandatory law requires otherwise.

 

For existing custom orders, the version in force when the order was accepted will usually continue to apply to that order unless we both agree otherwise.

 

17. Governing law and disputes

 

These Terms and any non-contractual obligations related to them are governed by the laws of Bulgaria.

 

If you are a consumer, any mandatory consumer protection rules of your country of residence remain unaffected.

 

We prefer to resolve disputes amicably first. If a dispute cannot be resolved informally, it shall be submitted to the competent courts of Bulgaria, unless mandatory law gives you the right to bring proceedings in another competent court.
